| Abstract: | Forest is a very important environment due to its existence benefits a lot like to accommodate water, natural residence, forest also have many kinds, where the forest types are divided into three differentiated parts depending parts depending on tree species composition, the geographical location of the forest, and also the influential climate of the forest. the problem in this research in how the regulation of forestry law in relation to change of allotment of forest for plantation, how the government’s procedures for changing the allocation of forest areas to non-forests for plantation in riau province and how the result of the settlement of the provincial government to the change of forest area allocation to non-forest for plantation, data collection techniques in this study is the method of library research ( library research) method is done by reading some literature in the form of a book of scientific books, legislation and scientific theoretical sources relating to government regulation on the environment and forestry ministries of the riau province, and research method ( field research ) in this research. Documentation was obtained from an archive of previous research activities that discussed government regulations on forest areas of the Riau ministry of environment and forestry. regulations on the procedure of designating forest conversion into non-forest areas : government regulation No.104 of 2015 on procedures for amendment of allotment, and carried out by presidential regulation No.88 of 2012, on settlement of land tenure within forest area, is : the minister after receiving the proposed change of forest areas designation for the provincial region of the governor, conduct technical review, the minister based on the results of the research and the recommendation of the integrated team as referred to in paragraph (4) shall issue a decision on the change of allotment of forest area for part or all of the proposed forest area, the result of the process of settlement of forest areas into non-forest area is the provincial government (provincial government) Riau deliberately change the status and function of forest area to bolster 32 corporation of oil palm plantation to non forest area or other designated area (APL). |
| Description: | Hutan merupakan lingkungan yang sangat penting keberadaannya dikarenakan manfaatnya yang banyak seperti menampung air, tempat tinggal alami. Hutan juga memiliki banyak jenisnya, dimana jenis hutan tersebut terbagi menjadi tiga bagian yang dibedakan tergantung komposisi jenis pohon, letak geografis hutan tersebut, dan juga iklim yang berpengaruh di kawasan hutan tersebut. Permasalahan dalam penelitian ini adalah bagaimana pengaturan hukum kehutanan dalam kaitannya terhadap perubahan peruntukan kawasan hutan menjadi bukan hutan untuk perkebunan, bagaimana tata cara yang dilakukan Pemerintah terhadap perubahan peruntukan kawasan hutan menjadi bukan hutan untuk perkebunan di Provinsi Riau dan bagaimana hasil penyelesaian yang dilakukan Pemerintah Provinsi Riau terhadap perubahan peruntukan kawasan hutan menjadi bukan hutan untuk perkebunan. Teknik Pengumpulan Data dalam penelitian ini adalah Metode Penelitian Kepustakaan (Library Research) Metode ini dilakukan dengan membaca beberapa litertur berupa buku-buku ilmiah, peraturan perundang-undangan serta sumber-sumber teoritis ilmiah yang berhubungan dengan Peraturan Pemerintah Tentang Kementerian Lingkungan Hidup Dan Kehutanan Provinsi Riau. Dan Metode Penelitian Lapangan ( Field Research) Dalam penelitian ini, dokumentasi diperoleh dari arsip kegiatan penelitian sebelumnya yang membahasa Peratutan Pemerintah tentang Kawasan Hutan Kementerian Lingkungan Hidup Dan Kehutanan Provinsi Riau. Peraturan tentang tata cara peruntukan perubahan hutan menjadi kawasan bukan hutan: Peraturan Pemerintah No. 104 Tahun 2015 tentang Tata Cara Perubahan Peruntukan, dan dikuatkan dengan Peraturan Presiden No. 88 Tahun 2012, tentang penyelesaian Penguasaan Tanah dalam kawasan hutan. Tata cara perubahan peruntukan kawasan hutan menjadi kawasan bukan hutan adalah: Menteri setelah menerima usulan Perubahan Peruntukan Kawasan Hutan untuk wilayah provinsi dari gubernur, melakukan telaahan teknis, Menteri berdasarkan hasil penelitian dan rekomendasi tim terpadu sebagaimana dimaksud pada ayat (4) menerbitkan keputusan Perubahan Peruntukan Kawasan Hutan untuk sebagian atau seluruh Kawasan Hutan yang diusulkan. Hasil proses penyelesaian peruntukan kawasan hutan menjadi kawasan bukan hutan adalah Pemerintah Provinsi (Pemprov) Riau sengaja mengubah status dan fungsi kawasan hutan membaut 32 korporasi perkebuan kelapa sawit menjadi non kawasan hutan atau Area Peruntukan Lain (APL). |
