Abstract: Hubungan (kerja) industrial antara pengusaha dengan karyawan yang kurang kondusif dapat menimbulkan perselisihan hak serta kepentingan karena kebuntuan komunikasi yang bersifat mendasar mengenai kewajiban, hak dan tanggung jawab. Hukum ketenagakerjaan dibangun untuk menciptakan ketertiban, kepastian hukum dan keadilan bagi masyarakat industri. Hal ini tidak terlepas dari teori hukum sebagai konsep peraturan perundang-undangan. Hal ini berdasarkan anggapan bahwa hukum sebagai kaidah berfungsi mengatur tingkah laku manusia ke arah yang dikehendaki pembaharuan Permasalahan dalam penelitian ini adalah: apakah faktor-faktor penyebab terjadinya pemutusan hubungan kerja pada putusan No. 266/Pdt.Sus- PHI/2021/PN.Mdn, bagaimana pemenuhan hak dalam pemutusan hubungan kerja berdasarkan putusan No. 266/Pdt.Sus-PHI/2021/PN.Mdn dan bagaimana pertimbangan hakim dalam perkara perselisihan hubungan industrial pada putusan No. 266/Pdt.Sus-PHI/2021/PN.Mdn. Metode penelitian yaitu dengan menggunakan jenis penelitian yang digunakan adalah yuridis normatif yaitu jenis penelitian yang dilakukan dengan mempelajari norma-norma yang ada atau peraturan perundang-undangan yang terkait dengan permasalahan yang dibahas. Sifat penelitian yang dipergunakan dalam menyelesaikan skripsi ini adalah deskriptif analis dari studi putusan kasus. Teknik pengumpulan data dengan studi kepustakaan dan lapangan, serta menganalisis data berdasarkan data kualitatif. Faktor-faktor penyebab terjadinya pemutusan hubungan kerja pada putusan No. 266/Pdt.Sus-PHI/2021/PN.Mdn adalah karena terjadinya pandemi yang sedang melanda di seluruh dunia, yang mengakibatkan pihak perusahaan harus mengurangi para pekerjanya, namun karena penggugat merasa terlalu lama dirumahkan, dan menyatakan tergugat telah melakukan pemutusan hubungan kerja sepihak, namun kenyataannya penggugat masih dirumahkan. Pemenuhan hak-hak karyawan yang diberhentikan berdasarkan putusan No. 266/Pdt.Sus- PHI/2021/PN.Mdn, hubungan kerja antara Penggugat dan Tergugat berakhir karena dikualifikasikan mengundurkan diri sesuai Pasal 51 Peraturan Pemerintah Nomor 35 Tahun 2021 tentang Perjanjian Kerja Waktu Tertentu, Alih Daya, Waktu Kerja dan Waktu Istirahat dan Pemutusan Hubungan Kerja. Menghukum Tergugat untuk membayarkan hak-hak Penggugat berupa uang penggantian hak sesuai Pasal 40 ayat (4) Peraturan Pemerintah Nomor 35 Tahun 2021 dengan total Rp.3.829.867,00 (tiga juta delapan ratus dua puluh Sembilan ribu delapan ratus enam puluh tujuh rupiah). Pertimbangan hakim dalam perkara perselisihan hubungan industrial pada putusan No. 266/Pdt.Sus-PHI/2021/PN.Mdn berdasarkan putusan tersebut, majelis hakim yang memeriksa perkara ini menimbang, bukti-bukti yang ada selama proses persidangan, baik dari bukti surat juga keterangan saksi-saksi. Industrial (work) relations between employers and employees that are not conducive can lead to disputes over rights and interests due to a deadlock in basic communication regarding obligations, rights and responsibilities. Employment law is built to create order, legal certainty and justice for industrial society. This is inseparable from legal theory as a concept of legislation. This is based on the assumption that law as a rule functions to regulate human behavior in the direction desired by reform The problems in this research are: what are the factors causing the termination of employment in the decision no. 266/Pdt.Sus-PHI/2021/PN.Mdn, how is the fulfillment of rights in termination of employment based on decision no. 266/Pdt.Sus-PHI/2021/PN.Mdn and what is the judge's consideration in the case of industrial relations disputes in Decision No. 266/Pdt.Sus-PHI/2021/PN.Mdn. The research method is by using the type of research used is normative juridical, namely the type of research carried out by studying existing norms or laws and regulations related to the problems discussed. The nature of the research used in completing this thesis is descriptive analysis of the case decision study. Data collection techniques with literature and field studies, as well as analyzing data based on qualitative data. The factors causing the termination of employment in the decision no. 266/Pdt.Sus-PHI/2021/PN.Mdn is due to a pandemic that is sweeping across the world, which has resulted in the company having to reduce its workers, but because the plaintiff feels he has been laid off for too long, and states that the defendant has unilaterally terminated the employment relationship. , but in fact the plaintiff is still being dismissed. Fulfillment of the rights of employees who were dismissed based on decision no. 266/Pdt.Sus-PHI/2021/PN.Mdn, the working relationship between the Plaintiff and the Defendant ended because he was qualified to resign in accordance with Article 51 of Government Regulation Number 35 of 2021 concerning Work Agreements for Certain Time, Outsourcing, Working Time and Rest and Termination Time Work relationship. Sentencing the Defendant to pay the Plaintiff's rights in the form of compensation money in accordance with Article 40 paragraph (4) of Government Regulation Number 35 of 2021 for a total of Rp.3,829,867.00 (three million eight hundred twenty-nine thousand eight hundred sixty-seven rupiah) . The judge's consideration in the case of industrial relations disputes in decision no. 266/Pdt.Sus-PHI/2021/PN.Mdn based on this decision, the panel of judges examining this case considered the evidence that existed during the trial process, both from letter evidence as well as statements from witnesses.
