Abstract: Salah satu tujuan pendaftaran tanah sebagaimana terdapat pada Pasal 3 huruf a Peraturan Pemerintah No. 24 Tahun 1997 tentang pendaftaran tanah adalah untuk memberikan kepastian hukum dan perlindungan hukum kepada pemegang hak atas tanah, satuan rumah susun dan hak-hak lain yang terdaftar dengan mudah dapat membuktikan dirinya sebagai pemegang hak yang bersangkutan. Sebagai alat pembuktian dinyatakan dalam sertipikat sebagaimana dinyatakan dalam pasal 32 ayat (1) Peraturan Pemerintah No. 24 Tahun 1997 bahwa sertipikat merupakan surat tanda bukti hak yang berlaku sebagai alat pembuktian yang kuat mengenai data fisik dan data yuridis yang termuat di dalamnya sepanjang data fisik dan data yuridis tersebut sesuai dengan data yang ada dalam surat ukur dan bukur tanah hak yang bersangkutan. Namun, tidak jarang masyarakat yang sudah memiliki sertipikat hak atas tanah menghadapi gugatan pihak lain yang merasa berhak atas tanah yang sudah disertipikatkan tersebut. Gugatan tersebut dilakukan melalui lembaga peradilan baik melalui Pengadilan Negeri maupun Pengadilan Tata Usaha Negara. Hal ini sangat mengganggu kenyamanan pemilik sertipikat atas ketidakpastian hukum terhadap kepemilikan sertipikat tersebut. Sehubungan dengan itu, penulis melakukan penelitian di Kantor Pertanahanan Kota Medan karena penulis terlibat dalam kegiatan pendaftaran tanah. Oleh sebab itu, penulis mencoba membuat analisis hukum yang dituangkan dalam Tesis yang berjudul: Analisis Hukum Terhadap Pembatalan Sertipikat Hak Atas Tanah (Studi Kasus Pembatalan Sertipikat Oleh Putusan Kepala Kantor Pertanahan Kota Medan No. 80/SK-12.71/VIII/2020 berdasarkan Putusan Pengadilan Tinggi Medan No. 366/PDT/2012/PT.MDN). Dalam menganalisis rumusan masalah dengan spesifikasi juridis normatif yang pendekatannya berdasarkan pendekatan Perundang-undangan (statue approach), pendekatan Sinkronisasi (Synchronization approach), pendekatan Kepustakaan (library approach) dan pendekatan Analisis (analytic approach). Sumber bahan hukum yang digunakan merupakan sumber bahan hukum primer, sekunder dan tersier. Penyebab sertipikat hak atas tanah dibatalkan oleh lembaga yang berwenang karena dinyatakan catat hukum administrasi atau catat administrasi ataupun tidak sah didasarkan terjadi kesalahan kesalahan dalam penerbitannya sesuai ketentuan pada pasal 107 Peraturan Menteri Negara Agraria/Kepala Badan Pertanahan Nasional (Permenag/KBPN) No. 9 Tahun 1999 Jo. Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional No. 11 Tahun 2016. Jenis kesalahan yang mengakibatkan catat hukum administrasi sebagaimana diuraikan pada Pasal 107 Permenag/KBPN No. 9 Tahun 1999 tersebut adalah: a. kesalahan prosedur, b. kesalahan penerapan peraturan perundang-undangan, c. kesalahan subyek, d. kesalahan obyek, e. kesalahan jenis hak, f. kesalahan perhitungan luas, g. terdapat tumpang tindih hak atas tanah, h. data yuridis dan data fisik tidak benar atau, i. kesalahan lain yang bersifat hukum administratif. Sebagai bentuk pertanggungjawaban terhadap putusan pembatalan sertipikat yang sudah berkekuatan hukum tetap oleh lembaga peradilan maka pihak lembaga pertanahan menindaklanjuti dengan menerbitkan keputusan pembatalan hak sesuai dengan kewenangannya sesuai dengan pasal 56 ayat (2) Peraturan Menteri Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional No. 11 Tahun 2016 tentang Penyelesaian Kasus Pertanahan. One of the objectives of land registration as stated in Article 3 letter a of Government Regulation no. 24 of 1997 concerning land registration is to provide legal certainty and legal protection to holders of land rights, apartment units and other registered rights that can easily prove themselves as holders of the relevant rights. As a means of proof stated in the certificate as stated in article 32 paragraph (1) Government Regulation no. 24 of 1997 that a certificate is a letter of proof of rights that applies as a strong means of proof regarding the physical data and juridical data contained in it as long as the physical data and juridical data are in accordance with the data contained in the letter of measurement and the book of land rights in question. However, it is not uncommon for people who already have land rights certificates to face lawsuits from other parties who feel they are entitled to the land that has been certified. The lawsuit is carried out through the judiciary, either through the District Court or the State Administrative Court. This greatly disturbs the comfort of the certificate owner due to the legal uncertainty regarding the ownership of the certificate. In connection with that, the authors conducted research at the Medan City Land Office because the authors were involved in land registration activities. Therefore, the author tries to make a legal analysis as outlined in the thesis entitled: Legal Analysis of the Cancellation of Land Rights Certificates (Case Study of Cancellation of Certificates by the Decision of the Head of the Medan City Land Office No. 80/SK-12.71/VIII/2020 based on a Court Decision High Medan No. 366/PDT/2012/PT.MDN). In analyzing the problem formulation with normative juridical specifications, the approach is based on the statutory approach, the Synchronization approach, the library approach and the analytical approach. The sources of legal materials used are primary, secondary and tertiary sources of legal materials. The cause of the certificate of land rights being canceled by the competent institution because it was declared an administrative law record or administrative record or invalid was based on an error in its issuance in accordance with the provisions in Article 107 of the Regulation of the State Minister of Agrarian Affairs/Head of the National Land Agency (Permenag/KBPN) No. 9 of 1999 Jo. Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency no. 11 of 2016. Types of errors that result in administrative legal records as described in Article 107 of the Minister of Religion/KBPN No. 9 of 1999 are: a. procedural error, b.errors in the application of laws and regulations, c. subject error, d. object error, e. right type error, f. area calculation error, g. there is overlapping land rights, h. juridical data and physical data are incorrect or, i. other errors of an administrative law nature. As a form of accountability for the decision to cancel a certificate which has permanent legal force by the judiciary, the land agency follows up by issuing a decision to cancel rights in accordance with its authority in accordance with article 56 paragraph (2) of the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency no. 11 of 2016 concerning Settlement of Land Cases.
