Abstract: Penerapan sanksi pidana bagi anak seringkali menimbulkan persoalan dilematis baik secara yuridis, sosiologis maupun secara filosofis. Untuk hal tersebut maka diperlukan konsep pemidanaan yang lebih humanistanpa harus diberikan sanksi penjara untuk anak. Konvensi negara-negara di dunia mencerminkan paradigma baru untuk menghindari peradilan pidana anak. Adapun penelitian ini memiliki penyusunan masalah sebagai berikut: 1.Bagaimana pengaturan hukum hak atas Pendidikan terhadap narapidana anak di Indonesia ? 2.Bagaimana pemenuhan hak atas pendidikan serta hambatan dalam proses pembinaan terhadap narapidana anak pada Lembaga Pembinaan Khusus Anak (LPKA) Kelas I Medan ?. Jenis penelitian ini merupakan peneltian Normatif yaitu suatu penelitian yang hanya didasarkan pada peraturan tertulis dimana dalam pengolahan data yang terdapat selama proses penelitian berupa penelitian kepustakaan dan penelitian lapangan. Upaya- upaya LPKA Kelas 1 Medan telah menggambarkan bahwa LPKA Kelas 1 Medan selalu berupaya agar teralisasinya peraturan-peraturan yang telah di keluarkan oleh pemerintah dalam menjamin agar setiap anak memperoleh pendidikan tanpa terkecuali bagi narapidana anak. Pemenuhan Hak Atas Pendidikan Serta Hambatan dalam Proses Pembinaan Terhadap Narapidana Anak pada Lembaga Pembinaan Khusus Anak (LPKA) Kelas I Medan terdapat program–program rehabilitasi sosial yang berorientasi ke pendidikan non formal maupun formal bagi narapidana anak. Hambatan- hambatan yang dialami LPKA Kelas 1 Medan salah satunya jarak sehingga terhambatnya pemenuhan data-data para narapidana anak. meskipun ada beberapa hak mereka yang terbatasi karena adanya konsekuensi sanksi hukum. Namun demikian masih diperlukan koreksi terhadap substansi hukum yang belum memberikan batasan-batasan tertentu yang belum jelas mengenai masalah yang menyangkut subyek dan obyek hukum mengenai hak pendidikan Anak Didik Lembaga Pemasyarakatan demi kesejahteraan anak itu sendiri. The application of criminal sanctions for children often creates dilemmatic problems, both juridically, sociologically and philosophically. For this reason, a more humanistic concept of punishment is needed without having to be given prison sanctions for children. The conventions of countries in the world reflect a new paradigm to avoid juvenile criminal justice. This research has the following formulation of problems: 1. How is the legal arrangement for the right to education for child prisoners in Indonesia? 2. How is the fulfillment of the right to education and obstacles in the process of fostering child prisoners at the Class I Medan Special Child Development Institute (LPKA)?. This type of research is a normative research, which is a research that is only based on written regulations where the data processing contained during the research process is in the form of library research and field research. The efforts of LPKA Class 1 Medan have illustrated that LPKA Class 1 Medan always strives for the realization of the regulations that have been issued by the government in ensuring that every child gets an education without exception for child prisoners. Fulfillment of the Right to Education and Obstacles in the Process of Coaching Child Prisoners at the Class I Medan Special Child Development Institute (LPKA) there are social rehabilitation programs oriented to non-formal and formal education for child prisoners. One of the obstacles faced by LPKA Class 1 Medan is distance, which hampers the fulfillment of data on child prisoners. although some of their rights are limited due to the consequences of legal sanctions. However, it is still necessary to correct the legal substance that has not provided certain unclear boundaries regarding issues related to legal subjects and objects regarding the education rights of Correctional Students for the welfare of the child itself.
