Abstract: Investasi syariah merupakan investasi yang didasarkan pada prinsip-prinsip syariah, baik investasi pada sektor riil maupun sektor keuangan. Adapun permasalahan dalam penelitian ini adalah bagaimana pengaturan hukum tentang investasi perumahan syariah dan keterkaitan aspek pidananya dan faktor-faktor apa saja sebagai penyebab investasi berinvestasi pada usaha prumahan syariah serta bagaimana penerapan hukum pidana bagi pelaku usaha investasi perumahan syariah (Studi Putusan No.48/Pid.B/2020/PNCkr). Metode yang digunakan di dalam penelitian ini adalah yuridis normatif dengan menggunakan bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Penelitian ini menggunakan teknik penelitian kepustakaan yang selanjutnya dianalisis secara kualitatif. Berdasarkan hasil penelitian pengaturan tentang investasi perumahan syariah di Indonesia diatur dalam KUHP, Undang-Undang No. 25 Tahun 2007 tentang penanaman modal, Undang-Undang No. 21 Tahun 2008 tentang Perbankan Syariah dan Undang-undang Nomor 1 Tahun 2011 tentang Perumahan dan Kawasan Permukiman. Faktor-faktor penyebab investasi berinvestasi pada usaha prumahan syariah yaitu faktor penegakan hukum, faktor ekonomi, faktor penawaran keuntungan pasti yang tidak wajar, faktor harga perumahan syariah murah. Penerapan hukum pidana bagi pelaku usaha investasi perumahan syariah dalam Putusan No.48/Pid.B/2020/PNCkr adalah keliru dan tidak tepat. Berdasarkan penelitian ini disarankan untuk kalangan pemerintah melakukan regulasi/peraturan mengenai masalah investasi perumahan Syariah agar nantinya tidak meluas kejahatan yang dilakukan si pelaku dan henedaknya meningkatkan kesadaran dan pemahaman masyarakat terhadap kegiatan-kegiatan investasi perumahan syariah, agar dapat terhindar faktor kerugian masyarakat yang terjerumus pada penipuan investasi perumahan syariah serta bagi pembuat kebijakan, dalam upaya penegakan hukum terkait kasus bisnis berkedok investasi perumahan syariah, maka setidaknya harus ada Undang-undang khusus yang mengatur tentang larangan investasi perumahan berkedok penipuan, penggelapan dan pencucian uang. Baik itu dalam sektor perdagangan maupun investasi. Shariah investment is an investment based on sharia principles, both investment in the real sector and the financial sector. The problem in this study is how the legal arrangements regarding sharia housing investment and the relationship between the criminal aspects and what factors are the causes of investment in investing in sharia home businesses and how to apply criminal law for sharia housing investment business actors (Study Decision No.48/Pid .B/2020/PNCkr). The method used in this research is normative juridical using primary legal materials, secondary legal materials and tertiary legal materials. This study uses library research techniques which are then analyzed qualitatively. Based on the results of research on the regulation of Islamic housing investment in Indonesia, it is regulated in the Criminal Code, Law no. 25 of 2007 concerning investment, Law no. 21 of 2008 concerning Islamic Banking and Law Number 1 of 2011 concerning Housing and Settlement Areas. The factors that cause investment to invest in sharia home businesses are law enforcement factors, economic factors, unreasonable definite profit supply factors, cheap sharia housing prices. The application of criminal law for sharia housing investment business actors in Decision No.48/Pid.B/2020/PNCkr is wrong and inappropriate. Based on this research, it is recommended for the government to carry out regulations/regulations regarding the issue of Sharia housing investment so that later the crimes committed by the perpetrators will not spread and should increase public awareness and understanding of sharia housing investment activities, in order to avoid the loss factor for people who fall into fraud. sharia housing investment and for policy makers, in an effort to enforce law related to business cases under the guise of sharia housing investment, then at least there must be a special law that regulates the prohibition of housing investment under the guise of fraud, embezzlement and money laundering. Both in the trade and investment sectors.
