dc.description.abstractPenanganan terhadap aksi demonstrasi, pihak kepolisian pada dasarnya sudah memiliki pedoman teknisnya, yaitu Peraturan Kapolri Nomor 16 Tahun 2006 tentang Pedoman Pengendalian Massa dan Peraturan Kapolri Nomor 8 Tahun 2010 tentang Tata Cara Lintas Ganti Dan Cara Bertindak Dalam Penanggulangan Huru-Hara. Penelitian ini untuk mengetahui upaya hukum Kepolisian Polrestabes Medan terhadap adanya pihak yang melakukan provokasi dan penghasutan kepada masa demonstrasi serta kendala penegakan hukum pidana terhadap terhadap adanya pihak yang melakukan provokasi dan penghasutan kepada masa demonstrasi. Metode penetian ini menggunakan jenis penelitian yuridis empiris dengan data sekunder yang diperoleh secara studi kepustakaan (library research) dan studi lapangan (wawancara). Kemudian, data diolah dengan menggunakan analisis kualitatif. Berdasarkan hasil penelitian diketahui bahwa upaya hukum Kepolisian Polrestabes Medan terhadap adanya pihak yang melakukan provokasi dan penghasutan kepada masa demonstrasi, akan melakukan tindakan pengamanan, yang apabila terjadi tindakan yang melanggar hukum atau mengarah ke perbuatan anarkis, pasti akan memancing perlawanan pihak lainnya, yang pada akhirnya menimbulkan banyak kerugian materiil dan immateriil bagi para pihak dan berdampak negatif pada stabilitas negara. Sehingga dengan demikian aparat kepolisian tetap melakukan penanganan secara serius terhadap pihak yang melakukan provokasi dan penghasutan kepada masa demonstrasi yang sekiranya telah melampaui batas-batas wajar yang telah ditentukan undang-undang berlaku atau dengan kata lain sering menjurus kepada tindakan-tindakan anarkis. Kendala penegakan hukum pidana terhadap terhadap adanya pihak yang melakukan provokasi dan penghasutan kepada masa demonstrasi, dimana terkendala karena massa pendemonstrasi tidak memberitahukan pihak Kepolisian bahwa akan melakukan demonstrasi, kurangnya koordinasi antara pendemonstrasi dengan aparat di lapangan, adanya provokator yang menyusup ke dalam massa, kerusuhan dalam Demonstrasi yang telah direncanakan, tidak adanya Perwakilan yang bersedia menanggapi massa pendemo, sikap petugas yang tidak mengindahkan perintah Pimpinan/Pengendali pengamanan di lapangan, kurangnya Personil dan peralatan pendukung dalam pelaksanaan pengamanan aksi demonstrasi. In handling demonstrations, the police basically already have technical guidelines, namely the National Police Chief Regulation No. 16 of 2006 concerning Guidelines for Crowd Control and the National Police Chief's Regulation No. 8 of 2010 concerning Procedures for Passing Changes and How to Take Action in Combat Combat. This study is to find out the legal efforts of the Medan Polrestabes Police against parties who provocation and incitement to the demonstration period as well as the obstacles to criminal law enforcement against the existence of parties who provoke and incite the demonstration period. This research method uses empirical juridical research with secondary data obtained by library research and field studies (interviews). Then, the data was processed using qualitative analysis. Based on the results of the study, it is known that the Medan Polrestabes Police's legal efforts against parties who provoke and incite the demonstration period will take security measures, which in the event of an action that violates the law or leads to anarchic acts, will certainly provoke resistance from the other party, which in the end caused a lot of material and immaterial losses for the parties and had a negative impact on the stability of the country. Thus, the police continue to take serious action against those who provoke and incite demonstrations that if they have exceeded the reasonable limits that have been determined by applicable law or in other words often lead to anarchic actions. Obstacles in the enforcement of criminal law against parties who provoke and incite demonstrations during the demonstration, which are constrained because the mass demonstrators do not notify the police that they will conduct demonstrations, lack of coordination between demonstrators and officers in the field, provocateurs who infiltrate the masses, riots in Demonstrations that have been planned, the absence of representatives who are willing to respond to mass demonstrators, the attitude of officers who do not heed the orders of the Leader/Controller of security in the field, lack of personnel and supporting equipment in the implementation of securing demonstration actions.en_US
