dc.description.abstractDi dalam kegiatan pemasaran dan distribusi produk barang atau jasa dilakukan secara seefektif mungkin oleh pelaku usaha atau produsen karena hal ini dimungkinkan agar dapat tercapai masyarakat yang sangat majemuk. Semua cara pendekatan diupayakan sehingga dapat menimbulkan berbagai dampak, termasuk keadaan yang menjurus pada tindakan yang bersifat negatif bahkan tidak terpuji yang berawal dari itikad buruk. Adapun dampak buruk yang lazim terjadi antara lain menyangkut kualitas atau mutu barang, informasi yang tidak jelas bahkan menyesatkan, pemalsuan dan sebagainya. Potensi demikian dapat menimbulkan terjadinya sengketa konsumen antara konsumen dengan pelaku usaha. Undang- Undang Nomor 8 Tahun 1999 tentang Perlindungan konsumen (UUPK) dibentuk dengan beberapa pertimbangan, antara lain karena ketentuan hukum yang melindungi kepentingan konsumen di Indonesia.. Adapun permasalahan yang di akan diambil adalah 1. Bagaimana proses pengajuan pembatalan putusan arbitrase BPSK pada Pengadilan Negeri?, 2. Bagaimana pertimbangan hakim dalam memberikan putusan sengketa konsumen berdasarkan putusan No. 94/Pdt.Sus- BPSK/2021/PN.Mdn? dan 3. Bagaimana akibat hukum pembatalan putusan BPSK oleh Pengadilan Negeri Medan atas keberatan pelaku usaha? Penelitian yang dilakukan adalah penelitian hukum normatif dengan pendekatan yuridis normatif yang menggunakan data sekunder dengan mengolah bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Berdasarkan hasil penelitian Proses pengajuan pembatalan putusan arbitrase BPSK pada Pengadilan Negeri adalah pihak yang merasa keberatan dalam putusan tersebut langsung mengajukan gugatan, disertai dengan alasan yang kuat dan juga bukti-bukti supaya dapat diproses di Pengadilan Negeri Medan. Pertimbangan hakim Badan Penyelesaian Sengketa Konsumen telah salah menerapkan hukum karena tidak berwenang melebihi kewenangan yang diberikan oleh Undang-Undang dalam memutus perkara tersebut. Mengingat antara PT. Mitra Pinasthika Mustika Finance melawan Peto Syamsul Alam adalah kasus perdata murni yaitu wanprestasi bukan sengketa konsumen. Akibat hukum dari pembatalan putusan BPSK oleh hakim dalam sengketa konsumen adalah putusan tidak bisa dilaksanakan eksekusi, sehingga bisa dianggap putusan tersebut tidak pernah ada. In the marketing and distribution of goods or services, business actors or producers are carried out as effectively as possible because this is possible in order to achieve a very diverse society. All approaches are pursued so that they can have various impacts, including situations that lead to negative and even commendable actions that originate from bad intentions. The bad impacts that commonly occur include the quality or quality of goods, information that is not clear and even misleading, forgery and so on. Such potential can lead to consumer disputes between consumers and business actors. Law Number 8 of 1999 concerning Consumer Protection (UUPK) was formed with several considerations, among others because of legal provisions that protect the interests of consumers in Indonesia. The problems to be taken are 1. How is the process of submitting the cancellation of the BPSK arbitration decision at the District Court ?, 2. What is the judge's consideration in giving a consumer dispute decision based on decision no. 94/Pdt.Sus-BPSK/2021/PN.Mdn? and 3. What are the legal consequences of the cancellation of the BPSK decision by the Medan District Court on the objections of business actors? The research conducted is normative legal research with a normative juridical approach that uses secondary data by processing primary legal materials, secondary legal materials and tertiary legal materials. Based on the results of the research, the process of submitting the cancellation of the BPSK arbitration decision to the District Court is that the party who objected to the decision immediately filed a lawsuit, accompanied by strong reasons and also evidence so that it could be processed at the Medan District Court. The consideration of the judges of the Consumer Dispute Settlement Agency has wrongly applied the law because it is not authorized to exceed the authority granted by the law in deciding the case. Considering that between PT. Mitra Pinasthika Mustika Finance against Peto Syamsul Alam is a pure civil case, namely a default, not a consumer dispute. The legal consequence of the cancellation of the BPSK decision by a judge in a consumer dispute is that the decision cannot be executed, so it can be considered that the decision never existed.en_US
