The application of legal reasoning by military judges in realizing the usefulness of law against desertion case decisions is very necessary to distinguish decisions for defendants who are present at trial and defendants who are not present at trial (in absenteeism). The criminal act of desertion can only be carried out by members of the TNI as regulated in Article 87 of the Criminal Procedure Code. The problem in this research is how is the application of legal reasoning in realizing the benefits of law by military judges on desertion case decisions? The method used in this research is normative juridical research. Sources of data used in this study is secondary data sources. Data collection techniques were carried out in two ways, firstly library research, and secondly field research. This study uses descriptive data analysis. Based on the results of the research obtained, the Judge in giving the final decision has its own legal reasoning for defendants who are present at the trial and those who are not present at the trial by giving the main and additional penalties. In applying legal reasoning that realizes this benefit, judges often encounter obstacles, namely waiting for the defendant to return to the unit, and There is a law that regulates the settlement of the crime of desertion (article 143 of Law No. 31 of 1997 concerning military justice) which requires the settlement of cases for 6 months.
