Abstract: Pandemi Covid-19 (Corona Virus Desease 2019) di awal tahun 2020 menjadi salah satu permasalahan hukum di Indonesia. Pandemi Corona menciptakan budaya baru dan alur baru untuk sistem pemidanaan dan hukum. Hukum berfungsi untuk mengatur kehidupan masyarakat agar dapat tercipta dan terpeliharanya ketertiban umum. Agar tidak menimbulkan kerugian atau menggangu kepentingan orang lain dalam usaha memenuhi kebutuhan hidupnya tersebut maka hukum memberikan aturan-aturan yang membatasi perbuatan manusia. Tujuan yang ingin dicapai melalui penelitian ini adalah sebagai berikut: untuk mengkaji dan menganalisis aturan hukum yang mengatur tentang orang yang melakukan tindak pidana di masa Covid 19, untuk mengkaji dan menganalisis faktor penyebab terjadinya tindak pidana dimasa Covid 19 serta tindakan yang dilakukan Polsek Delitua bila terjadi tindak pidana dan untuk mengkaji dan menganalisis upaya penanggulangan dimasa Covid 19 terhadap pelaku tindak pidana yang ditahan di Polsek Delitua. Metode penelitian dengan menggunakan jenis penelitian adalah penelitian yuridis normatif yaitu penelitian yang dilakukan dengan meneliti bahan pustaka (data sekunder) atau penelitian hukum perpustakaan serta fifat penelitian ini adalah deskriptif analis. Teknik pengumpulan data dengan menggunakan studi dokumen yaitu menggunakan data sekunder serta melakukan wawancara pada pihak di Polsek Delitua dan menggunakan analisis data secara kualitatif. Aturan hukum yang mengatur tentang tindak pidana yang terjadi pada masa covid 19 diatur pada undang-undang dan peraturan pemerintah yaitu UUD 1945, Kitab Undang-Undang Hukum Acara Pidana, Undang-Undang No. 2 Tahun 2002 tentang kepolisian, Peraturan Pemerintah No 21 tahun 2020 Tentang Pembatasan Sosial Berskala Besar (PSBB) pada masa Covid serta peraturan pendukung lainnya sepertu, Peraturan Presiden, Intruksi Presiden, Peraturan Gubernur, dan Maklumat Kapolri. Faktor penyebab pelaku melakukan tindak pidana di masa covid disebabkan oleh faktor inter yaitu agama, ekonomi dan kemiskinan serta pendidikan, juga faktor ekstern terdiri dari faktor lingkungan, pergaulan bebas dan kurangnya perhatian pemerintah dalam pemberian bansos. Upaya penanggulangan terjadinya tindak pidana di masa covid yaitu dengan melakukan upaya penal dan non penal dengan melakukan penyuluhan dan sosialasi tentang menjaga kesehatan, mencuci tangan, memakai masker bagi pengunjung tahanan, memberikan bansos untuk setiap masyarakat secara merata.----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------The Covid-19 pandemic (Corona Virus Desease 2019) in early 2020 has become one of the legal problems in Indonesia. The Corona pandemic creates a new culture and a new path for the criminal and legal systems. The function of law is to regulate people's lives so that public order can be created and maintained. In order not to cause harm or interfere with the interests of others in an effort to meet their needs, the law provides rules that limit human actions. The objectives to be achieved through this research are as follows: to study and analyze the legal rules governing people who committed criminal acts during the Covid 19 period, to study and analyze the factors that caused criminal acts during the Covid 19 period and the actions taken by the Delitua Police if they occurred. criminal acts and to study and analyze efforts to overcome during the Covid 19 period against perpetrators of criminal acts detained at the Delitua Police. The research method using this type of research is normative juridical research, namely research conducted by examining library materials (secondary data) or library law research and the nature of this research is descriptive analyst. The data collection technique used document studies, namely using secondary data and conducting interviews with the Delitua Police and using qualitative data analysis. The legal rules governing criminal acts that occurred during the Covid 19 period are regulated in government laws and regulations, namely the 1945 Constitution, the Criminal Procedure Code, Law No. 2 of 2002 concerning the police, Government Regulation No. 21 of 2020 concerning Large-Scale Social Restrictions (PSBB) during the Covid period as well as other supporting regulations such as Presidential Regulations, Presidential Instruction, Governor Regulations, and Chief of Police Notices. The factors that caused perpetrators to commit crimes during the Covid period were inter-factors, namely religion, economy and poverty as well as education, as well as external factors consisting of environmental factors, promiscuity and lack of government attention in providing social assistance. Efforts to tackle the occurrence of criminal acts during the Covid period, namely by making penal and non-penal efforts by providing counseling and socialization about maintaining health, washing hands, wearing masks for prison visitors, providing social assistance to each community equally.
