Abstract: Adapun permasalahan yang di akan diambil adalah bagaimana Proses Pemutusan Hubungan Kerja Akibat Kesalahan Berat Pada Putusan Nomor. 360/pdt.sus-PHI/2017/PN.Mdn Pasca Putusan Mahkamah Konstitusi Nomor.012/PUU-I/2003, dan Pertimbangan hakim pada putusan Nomor 360/Pdt.Sus-PHI/2017/PN.Mdn dalam pemenuhan hak-hak kepada pekerja yang di PHK. Penelitian ini merupakan penelitian normatif yang artinya adalah suatu penelitian yang dilakukan bertujuan untuk meneliti penerapan ketentuan-ketentuan Undang-Undang dan perundang-undangan dalam kaitannya dengan pemenuhan hak-hak pekerja yang menerima pemutusan hubungan kerja akibat kesalahan berat . Dari hasil penelitian pemutusan hubungan kerja akibat kesalahan berat yang tetap dapat dilakukan walau tanpa adanya putusan pidana yang berkekuatan hukum tetap berdasarkan Surat Edaran Menteri Nomor 3 Tahun 2015 tentang Pemberlakuan Rumusan Hasil Rapat Pleno Kamar Mahkamah Agung Tahun 2015. Putusan Mahkamah Konstitusi Nomor 12/PUU-I/2003, pekerja yang di PHK akibat kesalahan berat tetap berhak mendapatkan uang pesangon, uang penghargaan masa kerja, dan uang penggantian hak maupun upah proses. namun di dalam putusan pengadilan tersebut masih terdapat banyak celah hukum. The probem, which will be taken is how the work termination process caused by serious mistakes on Verdict No. 360/pdt.sus-PHI/2017/PN.Mdn post the Constitutional Court verdict No.012/PUU-I/2003 and Judge’s Consideration on verdict No 360/Pdt.Sus-PHI/2017/PN.Mdn about the employee fullfilments of rights that been fired. This research is a normative research, which means a research that aim to examine the application of law and regulation in relation to the employee fullfilment of rights that fired caused by fatal Fault post to the constitutional court verdict No. 012/PUU-I/2003. From the results of the study, termination of employment due to serious errors can still be carried out even without a criminal decision that has permanent legal force based on the Ministerial Circular Letter Number 3 of 2015 concerning the Enforcement of the Formulation of the Results of the Plenary Meeting of the Supreme Court Chamber of 2015. Decision of the Constitutional Court Number 12/PUU- I/2003, workers who are laid off due to serious misconduct are still entitled to severance pay, gratuity for years of service, and compensation for entitlements and processing wages. but in the court's decision there are still many legal loopholes.
