Abstract: Salah satu jenis tindak pidana yang sering dilakukan oleh Prajurit Tentara Nasional Indonesia (TNI) adalah tindak pidana desersi sebagaimana yang diatur dalam Undang-Undang Nomor 39 Tahun 1947 tentang Kitab Undang-Undang Hukum Pidana Militer (KUHPM) tepatnya di dalam Pasal 87 yang merupakan suatu cara bagi seseorang militer untuk menarik diri dari pelaksanaan kewajiban dinasnya. Padahal setiap prajurit TNI itu dituntut harus bersikap patuh terhadap otoritas dengan tradisi komando, esprit de corps tinggi, adanya kerjasama yang kompak, kohesi tinggi dan pemilikan disiplin yang kuat.Tindak pidana desersi memiliki ciri utama yaitu ketidakhadiran tanpa izin yang dilakukan oleh seorang militer pada suatu tempat yang ditentukan baginya, dimana militer tersebut seharusnya berada pada kesatuan untuk melaksanakan kewajiban dinas. Ketidakhadiran tersebut dapat berupa berpergian pada suatu tempat, menyembunyikan diri, menyeberang kemusuh, memasuki dinas militer negara lain, atau membuat dirinya tertinggal dengan sengaja. permasalahan dalam penelitian ini adalah aturan hukum yang mengatur tentang penyelesaian secara in absentia tindak pidana desersi,faktor penyebab dan upaya penanggulangan terhadap tindak pidana desersi secara in absentia yang dilakukan prajurit TNI di Pengadilan Militer I-02 Medan, Kebijakan Kriminal yang diterapkan kepada pelaku in absentia tindak pidana desersi yang dilakukan prajurit TNI di Pengadilan Militer I-02 Medan penyelesaian perkara tindak pidana desersi seringkali ditemukan beberapa kendala, yaitu salah satunya yang melakukan tindak pidana desersi tidak dapat ditemukan yang menyebabkan proses pemeriksaan dilakukan tanpa hadirnya (in absentia). In absentia yaitu pemeriksaan yang dilakukan supaya perkara tersebut segera diselesaikan dengan cepat demi tegaknya disiplin prajurit dalam rangka menjaga keutuhan pasukan. Termasuk dalam hal pelimpahan perkaranya yang tidak diperiksa karena sejak awal melarikan diri dan tidak diketemukan lagi dalam waktu 6 (enam) bulan berturut- turut terhitung sejak tanggal pelimpahan berkas perkara ke pengadilan pidana desersi In absentia, setelah putusan dibacakan Majelis Hakim di depan pengadilan yang terbuka untuk umum, maka pengadilan membuat pengumuman tentang putusan Pengadilan Militer dimaksud dan ditempelkan di Papan Pengumuman Pengadilan Militer One type of criminal act that is often committed by soldiers of the Indonesian National Army (TNI) is a criminal act of desertion as regulated in Law Number 39 of 1947 concerning the Military Criminal Code (KUHPM) to be precise in Article 87 which is a a way for a military person to withdraw from the performance of his service obligations. Even though every TNI soldier is required to be obedient to authority with a tradition of command, high esprit de corps, compact cooperation, high cohesion and strong discipline. The crime of desertion has the main characteristic of being absent without permission by a military person at a certain point. the place designated for him, where the military should be in the unit to carry out his duty of service. This absence can be in the form of traveling to a place, hiding oneself, crossing the enemy, entering military service in another country, or causing oneself to be left behind on purpose. The problem in this research is the legal rules governing the in absentia settlement of the crime of desertion, the causative factors and efforts to overcome the in absentia crime of desertion committed by TNI soldiers at the Military Court I-02 Medan, the Criminal Policy applied to perpetrators of in absentia. The desertion crime committed by TNI soldiers at the Military Court I-02 Medan. The settlement of cases of desertion crime often finds several obstacles, one of which is that one who committed the desertion crime cannot be found which causes the examination process to be carried out without his presence (in absentia). In absentia is an examination carried out so that the case can be resolved quickly for the sake of upholding the discipline of soldiers in order to maintain the integrity of the troops. This includes the transfer of cases that were not examined because they had fled from the start and were not found again within 6 (six) consecutive months from the date of transfer of case files to the desertion criminal court In absentia, after the decision was read out by the Panel of Judges in front of an open court. for the public, the court will make an announcement regarding the decision of the Military Court and post it on the Notification Board of the Military Court.
