Abstract: Impal adalah sebutan bagi orang yang sangat dianjurkan untuk dinikahi dalam adat orang karo yang semarga dengan garis keturunan ibu atau dari marga tertentu lainnya, tapi bukan semarga dengan bapak. Dalam perkawinan impal tidak mengenal istilah cerai (mulih). Dikatakan tidak dikenal cerai, karena pasangan suami istri masih berkerabat dekat. Permasalahan dalam penelitian ini adalah bagaimana akibat hukum perceraian pada perkawinan Impal menurut hukum adat Karo di Desa Gunung Setember, Kecamatan Gunung Sitember, Kabupaten Dairi dan bagaimana penyelesaian perceraian pada perkawinan Impal di masyarakat adat Karo di Desa Gunung Sitember, Kecamatan Gunung Sitember, Kabupaten Dairi. Jenis penelitian yang digunakan dalam penulisan skripsi ini adalah yuridis empiris yang bersifat deskriptif analisis. Lokasi penelitian di Desa Gunung Sitember, Kecamatan Gunung Sitember, Kabupaten Dairi. Hasil penelitian dan pembahasan, perkawinan impal di Desa Gunung Sitember sebagian besar tidak dicatatkan, sehingga jika terjadi perceraian maka akibat hukum dari perkawinan impal ini tidak memiliki kekuatan hukum yang berlaku meski secara agama dianggap sah, tetapi tidak diakui dimata hukum negara. Penyelesaian perceraian pada perkawinan impal, yaitu 1. Boleh cerai; dan 2. Tidak boleh cerai. Pertama, Boleh Cerai artinya dikatakan boleh cerai apabila kedua belah pihak keluarga setuju akan perceraian tersebut, dan di hadiri oleh kedua pihak dengan mengadakan acara yang disebut Sipulihen (saling mengembalikan). Maksudnya, pihak suami maupun pihak istri, saling mengembalikan pasangan ke keluarganya masing-masing secara baik-baik. Kedua, Tidak boleh cerai artinya, dalam perkawinan impal, tidak dikenal yang namanya perceraian (Mulih). Dikatakan tidak ada kata cerai karena mereka sudah berkerabat sebelum perkawinan. Jika mereka sepakat melakukan perkawinan Impal, artinya mereka setuju untuk tidak ada perceraian setelah melakukan perkawinan Impal. Impal is a term for a person who is highly recommended to marry in the custom of the Karo people who belong to the same family line as the mother's lineage or from certain other clans, but not from the same surname as the father. In impal marriage, there is no term divorce (mulih). It is said that divorce is not known, because the husband and wife are still closely related. The type of research used in the writing of this thesis is juridical empirical analysis which is descriptive in nature. The research location is in Gunung Sitember Village, Gunung Sitember District, Dairi Regency. The results of the research and discussion show that most of the impal marriages in Gunung Sitember Village are not recorded, so that if there is a divorce, the legal consequences of this impal marriage do not have legal force even though they are considered religiously valid, but not recognized in the eyes of state law. Settlement of divorce in impal marriages, namely 1. Divorce is permitted; and 2. No divorce. First, Permitted Divorce means that it is said that it is permissible to divorce if both sides of the family agree to the divorce, and are attended by both parties by holding an event called Sipulihen (mutual return). That is, the husband and wife, both return the couple to their respective families properly. Second, not being divorced means that in an impal marriage, divorce (Mulih) is not known. It said there was no word for divorce because they were related before marriage. If they agree to have an Impal marriage, it means that they agree that there is no divorce after entering into an Impal marriage.
