Abstract: Pengendalian impor barang yang diduga merupakan atau berasal dari hasil pelanggaran Hak Kekayaan Intelektual (HKI), secara mandatoris menjadi tugas Direktorat Jenderal Bea dan Cukai (DJBC), merupakan masalah yang sangat urgen untuk diteliti, mengingat dampak buruknya bagi masyarakat Indonesia. Permasalahan dalam penelitian ini, terkait kewenangan DJBC dalam pengendaliannya; pelaksanaan kewenangan DJBC dalam pengendaliannya; dan kendala dan upaya kewenangan DJBC dalam pengendaliannya. Mengacu pada permasalahan tersebut, maka penelitian ini menggunakan penelitian hukum normatif-terapan (applied law research). Hasil penelitian ini meliputi: Pertama, Kewenangan DJBC didasarkan pada Peraturan Pemerintah No. 20 Tahun 2017, dengan cara melakukan penegakan hukum melalui skema ex-officioatau yudisial. Kedua, pada pelaksanaan kewenangannya, DJBC telah berhasil melakukan penegahan, yaitu pada barang: Ballpoint Standart Pen Tipe AE 7 di Pelabuhan Tanjung Perak, pada tanggal 5 Desember 2019; dan Abrasive Cloth (Amplas) tipe JB-5 di Pelabuhan Tanjung Priok, pada tanggal 15 Januari 2020. Ketiga, Kendala meliputi: Data recording HKI yang minim, keberatan atas uang jaminan, dan pemegang hak diharuskan berbadan usaha. Upaya meliputi: Merevisi aturan agar terdapat relevansi aturan hukum; memaksimalkan kemampuan teknis petugas lapangan DJBC dalam menilai pelanggaran HKI; serta melaksanakan sosisalisasi secara masif kepada pemangku kepentingan. Control of the importation of goods suspected to be or originating from the results of violations of Intellectual Property Rights (IPR), mandatively becomes the duty of the Directorate General of Customs and Excise is a very urgent matter to be researched, given the adverse impact on the people of Indonesia. The problem in this study is related to the authority of DJBC in its control; the exercise of DJBC's authority in its control; and obstacles and efforts of the authority of DJBC in its control. Referring to these problems, this research uses applied law research. The results of this study include: First, the authority of DJBC is based on Government Regulation 20/2017, by carrying out law enforcement through ex-officio or judicial schemes. Second, in the exercise of its authority, DJBC has succeeded in blocking, namely on goods: Standard Pen Type AE 7 Ballpoint at the Port of Tanjung Perak, on 5 December 2019; and Abrasive Cloth (Amplas) type JB-5 at Tanjung Priok Port, on January 15, 2020. Third, Constraints include: Minimal IPR data recording, objections to security deposits, and right holders are required to be business entities. Efforts include: Revising rules so that there is relevance to the rule of law; maximizing the technical ability of DJBC field officers in assessing IPR violations; and implementing massive socialization to stakeholders.
