Abstract: Berdasarkan temuan data, ternyata masalah pencurian dalam Hukum Pidana dan Hukum Islam masih akomodatif untuk saat sekarang juga selaras dengan hak azasi manusia (HAM). Meskipun demikian masih ditemukan kontroversi dan pandangan skeptis terhadap efektifitas bentuk-bentuk hukuman dalam Hukum Pidana dan Hukum Islam. Hal ini dikarenakan adanya pemahaman yang parsial (sebagian-sebagian), landasan berpikir yang anti-pati dan fabio (benci) dan diluar konsepsi keimanan terkhusus dalam menilai Hukum Islam. Dapat disimpulkan bahwa adanya persamaan antara Hukum Pidana dan Hukum Islam dalam melihat persoalan pencurian, walau disatu sisi ditemukan perbedaan yang sangat tajam antara keduanya. Oleh karenanya, disarankan perlu adanya keterbukaan Hukum Pidana terhadap Hukum Islam sehingga dapat mencapai tujuan maksimal dari hukum itu sendiri. Based on the findings of the data, it turns out that the problem of theft in criminal law and Islamic law is still accommodating for the time being in line with human rights (HAM). Even so, controversy and skepticism are still found on the effectiveness of the forms of punishment in criminal law and Islamic law. This is because there is a partial understanding (in parts), the basis for thinking which is anti-patience and fabio (hate) and is outside the conception of faith, especially in assessing Islamic law. It can be concluded that there are similarities between Criminal Law and Islamic Law in seeing the problem of theft, although on the one hand there is a very sharp difference between the two. Therefore, it is suggested that the openness of criminal law towards Islamic law is necessary so that it can achieve the maximum objectives of the law itself.
