Analisis Implementasi Regulasi Penetapan Status Perlindungan Terbatas Ikan Terubuk (Tenualosa ilisha) Terhadap Ketersediaan Sumber Daya Ikan Dan Pendapatan Nelayan (Studi di Kecamatan Panai Hulu, Panai Tengah dan Panai Hilir)

Abstract

Untuk mengantisipasi terjadinya proses penurunan populasi yang menyebabkan kepunahan ikan terubuk di perairan Labuhanbatu, maka lahirlah Keputusan Menteri Kelautan dan Perikanan Republik Indonesia Nomor: 43/KEPMEN-KP/2016 tentang Penetapan Status Perlindungan Terbatas lkan Terubuk (Tenualosa ilisha) di wilayah perairan Sungai Barumun, Kabupaten Labuhanbatu. Keputusan Menteri tersebut tennasuk mengatur tentang pelarangan secara terbatas tersebut juga bersinggungan dengan waktu penangkapan yang dominan sehingga secara ekonomis juga berpengaruh secara signifikan pada ketersediaan sumber daya ikan. Pada penelitian ilmiah yang menggunakan pendekatan kualitatif dengan paradigma nonnatif interpretatif, teori yang ada dan digunakan dalam penelitian dikonstruksikan sebaga sebuah bangunan yang tidak sempuma, penelitiaan ini bersifat deskriptif, yaitu mengambarkan bagaimana pelaksanaan implementasi Keputusan Menteri Kelautan dan Perikanan Republik Indonesia Nomor: 43/KEPMEN-KP/2016 tentang Penetapan Status Perlindungan Terbatas Ik.an Terubuk (I'enualosa ilisha) dan pengaruh terhadap pendapatan nelayan serta hambatan dan kendala dari implementasi tersebut, sehingga dapat digambarkan bahwa Implementasi Keputusan Menteri Kelautan dan Perikanan Republik Indonesia Nomor: 43/KEPMEN-KP/2016 tentang Perlindungan Terbatas Ikan Terubuk (I'enua/osa ilisha) telah terlaksana dalam bentuk kegiatan sosialisasi, patrol laut dan monitoring yang dilakukan oleh Pemerintah, Tentara Nasional Indonesia, Kepolisian dan kelompok pengawas masyarakat, efektivitas dari implementasi Keputusan Menteri Kelautan dan Perikanan Republik Indonesia Nomor: 43/KEPMEN-KP/2016 tentang Perlindungan Terbatas Ikan Terubuk (Tenualosa ilisha) terhadap ketersediaan sumber daya ikan secara yuridis dan dilihat dari· hasil tangkapan nelayan mengalami peningkatan dan cukup efektif, namun belum signifikan karena penindakan sanksi atas pelanggaran belum terwujud dan hambatan dan kendalan dari implementasi Keputusan Menteri Kelautan dan Perikanan Republik Indonesia Nomor: 43/KEPMEN-KP/2016 tentang Perlindungan Terbatas lkan Terubuk (Tenualosa ilisha) menemui kendala yaitu implementasi peraturan yang tidak tersosialisasi secara luas, tidak diringi dengan bantuan sarana dan prasarana terhadap nelayan sangat minim dan tidak sesuai dengan sosial budaya masyarakat yang lebih terikat pada kearifan lokal. In scientific research that uses a qualitative approach with interpretative normative paradigms, the existing theories and used in research are constructed as imperfect buildings, this research is descriptive in nature, which illustrates how the implementation of the Decree of the Ministzr of Marf time Affairs and Fisheries of the Republic of Indonesia Number: 43 I KEPMEN- KP I 2016 concerning Determination of the Status of Limited Terubuk Fish Protection (Tenualosa ilisha) and the influence on fishermen's income as well as obstacles and obstacles from the implementation, so it can be illustrated that the Implementation of the Decree of the Minister of Maritime Affairs and Fisheries of the Republic of Indonesia Number: 43 I KEPMEN-KP I 2016 concerning Protection Limited Terubuk Fish (Tenualosa ilisha) has been carried out in the form of socialization activities, sea patrols and monitoring carried out by the Government, the Indonesian National Army, Police and community watch groups, the effectiveness of the implementation of the Decree of the Minister of Maritime Affairs and e fisheries of the Republic of Indonesia Number: 43 I KEPMEN-KP I 2016 concerning Limited Protection of Terubuk Fish (Tenualosa ilisha) against juridical availability of fish resources and seen from fishermen's catches has increased and is quite effective, but not yet significant because sanctions for violations have not been realized and obstacles and constraints of the implementation of the Decree of the Minister of Maritime Affairs and Fisheries of the Republic of Indonesia Number: 43 I KEPMEN-KP I 2016 concerning the Limited Protection of Terubuk Fish (I'enualosa ilisha) encountered obstacles, namely the implementation of regulations that are not widely socialized, not accompanied by the assistance of facilities and infrastructure for fishermen are very minimal and not in accordance with the socio-cultural community that is more tied to local wisdom.
